Delk Law Firm

Traffic Violations

In addition to minor criminal matters, Delk Law Firm handles traffic violations from minor speeding tickets to serious driving under the influence violations (DUIs). Our lawyers have more than thirty-five years of combined experience in District Court (which deals with traffic matters). Many of these cases can be resolved to decrease or eliminate potential points on your license or on your insurance. Additionally, most cases can be handled without your presence in Court, saving you both time and money.

I received a speeding ticket in Caldwell County, but I live in another county/state. Can DLF help?

Most speeding violations and other traffic-related violations can be handled without the Client's presence in court. We have all Clients sign a "Waiver of Appearance," which can be mailed, faxed or e-mailed to us. This document allows us to represent you without your presence here.

I have multiple charges on the same ticket; will I have to pay attorney fees for each charge?

Depending on the nature of the charges, we will usually handle all traffic charges on the same court day as if they were a single charge, but depending upon the severity of the charge and the number of charges, our fees will vary. Please call us to discuss fees if you have any questions. Because every case is different, we do not have a "schedule of fees" to post online.

I don't want this speeding ticket to affect my insurance. Can DLF help?

Depending on the charge, we can and do plead many speeding violations to "Improper Equipment," a non-moving violation not adding points to your license and not usually to your insurance. The court system provides many ways to avoid license points to drivers with no or few prior violations. Please call us to discuss the specifics of your case and we can offer an anticipated outcome of your case, though no outcome is guaranteed.

I want my matter handled as soon as possible, but I'm short on cash right now. What are my options?

We require all new clients to pay attorney fees and estimated court costs prior to our representation or appearance in court. However, if you require more time to pay past your court date, we will continue your case if half of the attorney fees are paid prior to that first court date. Additionally, we accept all major credit cards, but we will add a 3% transaction fee to all credit card payments.

If you are in need of help with a traffic violation, please contact Stephanie, our Criminal Paralegal, via e-mail or telephone (828-757-0783).
